What is Proposition 65?
The purpose of Prop 65 is to ensure that the public is informed about the potential exposure to chemicals known to cause cancer, birth defects, or other reproductive harm. The original intent of the law was to protect drinking water sources from chemical contamination. However, since 1986 the scope of the law has grown to over 900 chemicals including a wide range of naturally occurring and synthetic chemicals that include additives or ingredients in pesticides, common household products, food, drugs, dyes, or solvents. The law requires companies to provide a warning on their products and/or packaging if their products contain one or more of these listed chemicals.
What does a Proposition 65 warning mean?
If a warning is placed on a product label or posted or distributed at a workplace, a business, or in rental housing, the business issuing the warning is aware or believes that it is exposing individuals to one or more listed chemicals. A warning must be given unless it can be demonstrated scientifically that the chemical poses “no significant risk.” For chemicals that can cause cancer, for example, the “no significant risk” level is defined as the level which is calculated to result in not more than one excess case of cancer in 100,000 individuals exposed over a 70-year lifetime.
